Comment:

The first indicator sounds good.

The second one is not very clear and does not say enough about the usefulness of the process for registering. We need to know how many people have complaints about judicial and administrative misconduct and we need to know how many people do really complain. The objective is to have a low amount of people who could complain and a high level of those people who do complain. We want that 100% of the complaints will be registered.
Please think about it and develop a new indicator and send it back to me.

Comment:

In this case it would be fine to have baseline studies of complaints and of cases without a formal complaint to be able to introduce a % of decreasing of such cases for improving the situation.

How could it be?


A judge and members of the judge’s family shall neither ask for, nor accept, any gift, bequest, loan or favour in relation to anything done in connection with the performance of judicial duties.
A judge shall not knowingly permit court staff to ask for, or accept any gift, bequest, loan or favour in relation to anything done in connection with his or her duties.
Court employees shall not use or attempt to use their official positions to secure unwarranted privileges, gifts, favours, gifts or exemptions, for the use of themselves or others.
Each employee shall use the resources, property and funds under the employee’s official control judiciously and solely in accordance with prescribed statutory and regulatory procedures

Comment:

How many years

It is necessary to have a baseline study. When we want to have an increase or decrease it is always necessary to have baseline studies to be able to measure the changes.
If we only count the formal complaints it is possible that we lose an important number of cases, when the people do not complain formally.





The court is to be beyond undue influence of the legislative and executive branches of government and popular majorities

Comment:

We do not want to have an increase of 5 %, we want to have a decrease of decisions against government, AND we want that the people use the means they have to complain in a case of problems with a judge. We can use this indicator but we should add a second or third one, because if not we need to increase the decisions against judges every year (during the next 20/30/40 years?????) and this is not our objective. This is a perfect example of a perverse indicator, because it seems ok but finally it is not.

Appointment procedures ensure that the selection of judges is unaffected by personal influence or private interest

Recruitment and retention of judges is reviewed and upgraded over a period of time, according to established standards
“Period of time” has to be specific.

We should look for an appointment procedure document and for the proper application of such a document.

One indicator could be the number of family members who are working in the same court: e.g. Less than 2, then we could define the minimum level of formal education a judge should have etc. because these are indicators that “indicate” a correct appointment procedure.

The court recognizes its responsibility to communicate with the public and the media.

Although this is a standard from an international system, I would say that it should be modified to be a useful standard. Finally it is not enough that the court recognizes its responsibility but it would be necessary that they communicate with the public and with the media.



Number of simplified Information Education and Information materials produced and circulated and number of feedback received from the media and members of the public through these materials.
Comment: Separate into 2 indicators. Define the number of material you want to find and the number of feedback you consider to be necessary to decide that the standard has been fulfilled.
